Assemblyman Ron Kim has recently unveiled the “Justice for Nursing Home Victims Act,” a proposal that includes a $4 Billion Victim Compensation Fund and amendments to New York State’s definition of “Wrongful Death” and “Statute of Limitations.” This bill will broaden the legal options available to families and provide assistance for those who have lost loved ones due to New York State’s mismanagement of long-term care facilities, nursing homes and assisted living communities during the COVID-19 pandemic.

Many families believed their loved ones were living in safe environments, shielded from contracting the coronavirus. Assemblyman Kim’s “Justice for Nursing Home Victims Act” seeks to assist families who unexpectedly lost loved ones to COVID-19 within any type of long-term care facility.

Not being able to see family and friends while in a long-term care facility during the pandemic left many people feeling helpless and isolated. Before succumbing to COVID-19, many victims experienced depression, anxiety and confusion. As a loving family member or caregiver of someone who died due to COVID-19, you may be heartbroken, frustrated and feeling emotionally and financially insecure. You are not alone.

You may be entitled to compensation if a loved one died due to COVID-19 while living in a long-term care facility, nursing home or assisted living community in New York State. As one of the largest law firms in New York and with over 40+ years of experience in elder law, Feldman, Kramer & Monaco, P.C. (FK&M) is here for you and your family.
